Buna <strong>ya\u011fmal\u0131 \u015f\u00f6len, yahut<\/strong> me\u015fhur ad\u0131yla <strong>H\u00e2n-\u0131 Ya\u011fma<\/strong> denirdi.. Bu anlamda <strong>O\u011fuz toy<\/strong>lar\u0131 me\u015fhurdur. \u0130bn-i Fazlan seyahatnamesinde <strong>O\u011fuz toylar\u0131<\/strong>ndan bahseder, \u00a0Beylerle komutanlar\u0131n yan\u0131 s\u0131ra halk\u0131n da verilen <strong>ya\u011fma<\/strong>ya kat\u0131ld\u0131\u011f\u0131n\u0131 belirtir.<\/span><\/p>\n<p style=\"text-align: justify\"><span style=\"font-size: 14px\">\u00d6yle ki bu gelenek T\u00fcrk t\u00f6resinde hukuk\u00ee bir team\u00fcl haline gelmi\u015ftir.\u00a0 Sel\u00e7uklu tarih\u00e7isi Prof. Osman Turan bu konuda \u015funlar\u0131 s\u00f6yler: <em>\u201cHanlar\u0131n O\u011fuz beylerine toy ve \u015f\u00f6len denilen umumi ziyafetler vermesi ve bu ziyafetlerde Han saray\u0131n\u0131n ya\u011fma edilmesi (H\u0131v\u00e2n-\u0131 Ya\u011fma) us\u00fbl idi. Bir fark daha: \u00c7apul\u2019da payla\u015f\u0131m yok, Ya\u011fma\u2019da payla\u015f\u0131m var. Eski gelenekte <strong>\u00e7apul<\/strong> d\u00fc\u015fmana yap\u0131l\u0131rken \u015fimdi kendi \u015fehir ve insan\u0131na yap\u0131l\u0131yor.\u00a0<\/span><\/p>\n<p style=\"text-align: justify\"><span style=\"font-size: 14px\">\u0130lgin\u00e7 olan\u0131 \u015fu ki; eskiden Hakan her \u015feyini ya\u011fmalat\u0131rd\u0131, toya \u00e7a\u011fr\u0131lanlar ya\u011fma yapard\u0131. \u015eimdi ise <strong>ya\u011fma<\/strong>n\u0131n \u015fekli de\u011fi\u015fti. Toy sahibinin de\u011fil, toya \u00e7a\u011fr\u0131lmayanlar\u0131n mal\u0131, her \u015feyleri ya\u011fmalan\u0131yor. Nerede bir b\u00e2kir \u015fehir topra\u011f\u0131 g\u00f6rse oraya sald\u0131ran \u00e7apulcu ve ya\u011fmac\u0131lar bir zamanlar\u0131n <strong>\u201cmedeniyet tecellig\u00e2h\u0131\u201d<\/strong> \u015fehirleri katletti, kimyas\u0131n\u0131 bozdu, ruhunu yok etti.<\/span><\/p>\n<p style=\"text-align: justify\"><span style=\"font-size: 14px\">Ne yaz\u0131k ki <strong><em>tarih\u00ee s\u00fcreklilik<\/em><\/strong> \u015fehir \u00e7apul ve ya\u011fmas\u0131yla devam ediyor, yeni \u015fehirler in\u015fas\u0131yla de\u011fil! \u00c7\u00fcnk\u00fc \u015fehirlerimiz, <strong>\u00e7apul ve ya\u011fma<\/strong>y\u0131 me\u015fru hale getirmi\u015f, asla kamu vicdan\u0131, kamu mal\u0131, kul hakk\u0131 diye bir endi\u015fesi olmayan \u015fehir ya\u011fmac\u0131lar\u0131n\u0131n \u00e7apul alan\u0131 haline geldi. \u00c7apulcu\u2019yu, ya\u011fmac\u0131\u2019y\u0131 hi\u00e7bir kanun engelleyemiyor, hi\u00e7bir g\u00fc\u00e7 \u00f6n\u00fcnde duram\u0131yor. Bir kas\u0131rga gibi \u015fehirlerimizi kas\u0131p kavuruyor.<\/span><\/p>\n<p style=\"text-align: justify\"><span style=\"font-size: 14px\"><strong>\u00c7apul ve Ya\u011fma<\/strong>\u2019n\u0131n bir <strong>varolu\u015f bi\u00e7imi<\/strong> oldu\u011fu d\u00f6nemde, Yusuf Has Hacip bin y\u0131l \u00f6nce yazd\u0131\u011f\u0131 Kutadgu Bilig\u2019de <em>\u201cD\u00fcnyan\u0131n her taraf\u0131 ba\u015ftan ba\u015fa bozuldu. Buna bak\u0131p, hayret eden bir kimse var m\u0131?\u201d<\/em> diye soruyordu. Eserinin sonunda da <em>\u201cB\u00fct\u00fcn iyiler gitti, kanunu ve iyi an\u2019aneleri beraberlerinde g\u00f6t\u00fcrd\u00fcler; burada insan art\u0131\u011f\u0131 kald\u0131, iyileri nas\u0131l bulay\u0131m\u2026 Onlar akrep gibi sokarlar, sinek gibi kan\u0131m\u0131 emerler, k\u00f6pek gibi havlarlar; hangisine yeti\u015feyim.\u201d<\/em> diye feryad eder.<\/span><\/p>\n<p style=\"text-align: justify\"><span style=\"font-size: 14px\">Bu fery\u00e2d\u0131n bug\u00fcn hi\u00e7bir kar\u015f\u0131l\u0131\u011f\u0131 yok. \u00c7\u00fcnk\u00fc \u015fehre \u00fc\u015f\u00fc\u015fen \u00e7apulcu ve ya\u011fmac\u0131lar\u0131n birbiriyle akrabal\u0131\u011f\u0131n\u0131n g\u00f6stergesi olan \u015fehirlerimizin bug\u00fcnk\u00fc hali <strong>\u015fehre dair hi\u00e7bir fery\u00e2d\u0131n<\/strong> duyulmad\u0131\u011f\u0131n\u0131 g\u00f6steriyor.<\/span><\/p>\n<p style=\"text-align: justify\"><span style=\"font-size: 14px\">Hi\u00e7 kimseyi itham ve ilzam etmiyoruz. \u015eehre dair i\u00e7imizdeki yang\u0131n\u0131 bu iki kelimeye anlam y\u00fckleyerek ifade etmektir murad\u0131m\u0131z.
